Cheap air fare without earning miles in rewards program.

We usuaaly try to flight by one of the Star Alliance members due to its rewards program. Last time we did Rio-Madrid-Rio we had 3 options: TAM, TAP and Iberia. We readily dismissed Iberia for not scoring (both TAM and TAP are Star Alliance members).

So we choosen TAP (portuguese) over the more expensive TAM (brazilian) and when we arrived back we got surprised when TAP said us that by the class purchased it was not possible to earn points/miles.

As we were deliberately induced to purchase it due to the rewards program (and nothing was told about that "no miles ticket " before, except that microscopic words) we are planning to prosecute both companies in order to earn these miles. Is that fair?! What about the jurisprudence on that issue?

Quite common that the lowest fares don't earn miles on lots of airlines these days.

As you say, it was in fine print, you just assumed incorrectly that you could earn miles. Annoying but no fault of the airline.

You really need to dissect the language of the T&C to see if you have a leg to stand on. If they are in the wrong, a nice but firm letter to the airline executives or a post on Facebook or Twitter could do wonders. As the previous poster said, suing will not be worth it even if they are in the wrong.

BTW, Iberia is a Oneworld member, so their miles are not exactly useless.

I agree, don't waste your time and money. You have simply learned a valuable but expensive lesson for next time - don't assume that any fare will earn you miles. Always look at the rules for that specific fare class. Even more expensive tickets can earn only partial mile credit.

I doubt that a claim that the print was too small would stand up in a court of law. If it was there then you should have read it even if it meant getting a magnifying glass.

As a rule of thumb: the smaller the print the more important the content.

Just put it down to experience and know for next time. It's not uncommon with some airlines that cheap fares don't attract points.

In any event, the days of "small print" are long gone, you can make the text whatever size you want, so the only excuse you'll have is that this is not explained anywhere on the website or in the Ts&Cs.

And it can be hard to find, especially if this Is not something you are even aware of so you aren't looking for it.

FWIW it's likely NOT in the Ts&Cs of your ticket, but in the frequent flyer program. There will likely be a phrase such as "only tickets bought in classes x, y and z are eligible" or " tickets bought in classes a, b, c are not eligible" . And then it's up to you to do the work to dermine the booking class of your ticket and work it out.

This is a lesson many of us learned the hard way. If its any consolation, it may be that the money you saved was more than enough to compensate, it all depends, sometimes you can save a lot, other times a very minor amount.

As for legal action, forget about it, they will easily be able to point out where "your" mistake was.

Actually, when you book direct with most airlines IME it's displayed one way or another with the fare. It may be part of the fare break down which helps you compare different fares, it may be that you have to hover your cursor over the fare or fare class, or click the fare class letter, but it is usually there somewhere.

For example with Air Canada it's here: aircanada.com/shared/…pop_faretypes_int.html The link to this page is displayed on all fare searches, and if you hover over the fare class description the basic info comes up.
