Monarch airlines 50% reduction in delay compensation

Monarch airlines reduced our flight delay compensation by 50% for a delay of between 3 and 4 hours. This is not what the CAA website indicates. Can Monarch do this and what should Is my next move. Any advise please.

Were you re routed? Where rerouting is offered and results in the passenger arriving within two/three/four hours (depending on length of flight) of the scheduled arrival time, the compensation payable is halved.

"Can Monarch do this"

In short, yes *if* the following conditions are met:

- Your delayed flight was NOT an intra-community flight.

- Your delayed flight was more than 3500 km.

The relevant legal paragraphs are EU261 article 7(2) and the ECJ Sturgeon ruling paragraph 63.

Monarch appear to be reducing compensation payouts by 50% for ALL flights delayed between 3-4 hours. There is no basis in law for this (Lexexpress has reproduced the criteria). I am aware of one person who has so far taken them to court - and Monarch failed to submit a defence. I think that tells you everything you need to know. About Monarch as much as the issue.

At least Monarch aren't saying they only have to pay out for delays up to 2 years ago. They're all the same in trying to avoid paying out, and none are worse than others (amongst charters/lccs).
