Tearing down 11 restaurants and bars nai yang beach

We have booked to stay at TT Naing Beach Hotel in November/December in Phuket, as its on the beach this hotel may also be pulled down. We were looking for a holiday with beach restaurants etc, would we be better to now stay in Khao Lak as we have done on a previous holiday.

As you have stayed in Khao Lak before you will know that the beach restaurants there are set back from the beach and there are no resorts built directly on the beach as in areas of Phuket that have given rise to them being pulled down. With one exception sun beds are back from the beach on the edge of the resorts/beach restaurants. Nevertheless I am sure all areas of Khao Lak and other beach destinations will in turn be subject to scrutiny to ensure they comply with the rigorous application of Thai legislation. Certainly looking at the location of the TT Nai Yang Beach Hotel directly on the beach I would be very nervous about staying there as by all accounts it will have to be demolished. There are other beach areas on Phuket where although illegal beach side restaurants have been demolished other legal ones on private land facing the beach remain. Hopefully those more familiar with them will advise accordingly.

Thanks for the info Arandora, at least we can make an informed choice, the hotel in Phuket has sent us an email saying that they are not affected by this action but can they be sure they wont be in the future.

Hi

I have contacted the owners of Dang Sea Beach Bungalows, who are just about next to TT. If they own the land and have the papers showing that then they should be ok. Why not contact the hotel owner directly.

As the rules are being set by the Junta it is hard to know what they have in mind, but I believe the aim is to clear up illegal shops / restaurants / hotels who have used 'public' land to set up their business. If the building is on their own privately owned land then they won't be moved on.

Thank you for the info, we were looking to take advantage of all the restaurants on the beach but now that is not possible. It was all part of the attraction for us. We have cancelled the hotel due to the uncertainty of the situation, as you so rightly say we cannot see what the junta have in mind. We have now booked the Orchid Beach Resort in Khao Lak

Many thanks

The problem, with respect, is not the rules set by the junta, it is the illegal transfer of titles to land that have taken place. The new Phuket Administration supported by the Military are the ones taking action. As far as all the information I have seen says no business has or has ever has had the legal right to operate commercially on the beach. Previously a blind eye was turned to this, enforcement of the law not having previously been one of Thailand's strong points. Those who have what they regard as "legal" title to the land and have built permanent structures, like the beach side resorts, are contesting the orders to remove/demolish their property. Until they are forced to do so they will continue to trade and say there is no problem. Time will tell.

The Orchid Beach is an excellent resort.

You can see from this that the action and resistance from owners is not limited to Nai Yang phuketwan.com/tourism/…

Dang Sea saying If they own the land and have the papers showing that then they should be ok would not relieve any concern I had about booking.

TT Nai yang just like Dang Sea and others are there illegally, this is why they all buy their electricity from businesses across the road because they don’t really exist.

From corrupt Parks officials signing off MOU’s and apparently redrawing park boundaries to government officials paying off locals with garbage pickup on the beach side after stopping the red shirts setting up a base in Nai Yang and turning a blind eye to the rampant building that has been going on for the last few years. Its a legal mess.

Nai Yang beach was being looked at half-heartedly by some just before the Coup with places like Kobi’s restaurant being told to remove their illegal thatch huts from the beach and replace them with plastic tables and chairs, the difference anyone’s guess.

Now with the military telling local government to follow the law or be replaced Nai Yang Beach is being looked at allot harder.

It’s easy for the official’s and the military to come in and tear down a few bamboo hut restaurants but to sort out the rest of the mess Nai Yang is could take a month or years. Or it could just be put into the too hard basket.

My bet is it will be forgotten about, but would I put money on that and book at TT or any other beachside hotel. NO
