Black mould growing in 5* holiday apartment

We had to vacate a holiday apartment in Cornwall due to a large amount black mould on bedroom walls. I requested a refund from the time we left to move to another self catering property, but this has been refused. Any advice on our rights please? Can we get the money back?

Small Claims Court - you might want to contact Environmental Health, Trading Standards & the local Tourism Board to whereever the place is

Might be a bit late for this but did you take photos and contact your letting agent immediately? That would be the very first thing. The letting agent should have been there immediately to assess the complaint and either rectify it or offer alternative accommodation.

If you took it upon your self to leave and then contact the company on your return home then they are well within their rights to refuse you any refund as you did not give them a chance to put things right.

Small claims court will be costly and not worth it for much less than £5K. Find out if the agency is affiliated to a tourist board (Visit Cornwall or similar) or if the property was independently inspected - who awarded the 5* rating? Then contact them and copy the agency in on your correspondence. Good Luck.

Thanks Colibrum. We did take photos after caretaker lied and said there was no mould. Sent them to owner who is abroad. He then suggested we caused it! We have now sent photos and email corres to English Tourist Board who awarded 5*. Owner accused us of putting his hard won grading at risk! We told owner via email we were planning on moving out. The mould is not something that could be put right while we were in occupation. I'm not sure that it wouldn't be worth going to small claims court, as it seems to cost £70 to apply which isn't a huge amount, but of course we might not get it.
