Se supone que los extranjeros no deben pagar IVA impuesto. Aunque le dije que ningun otro hotel lo habia cobrado. Nos mando al aereopuerto a donde dijo nos lo devolverian. La empleada de la devolucion de impuestos en el aereopuerto no dijo que no podia hacer nada pues el hotel no deberia haverlo cobrado! Este fue un hotel de primera el Crown Plaza Taquendama. Cuidado! Sabe alguien como recobrar ese dinero?

Ahora, cuando los hoteles prestan servicios a un extranjero como se enuncia en el literal d) del artículo 481 del E.T., modificado con el artículo 55 de la Ley 1607 de 2012, esos servicios turísticos prestados a extranjeros continúan apareciendo:

“d) Los servicios turísticos prestados a residentes en el exterior que sean utilizados en territorio colombiano, originados en paquetes vendidos por agencias operadores u hoteles inscritos en el registro nacional de turismo, según las funciones asignadas, de acuerdo con lo establecido en la Ley 300 de 1996. En el caso de los servicios hoteleros la exención rige independientemente de que el responsable del pago sea el huésped no residente en Colombia o la agencia de viajes”.

Hotel charged IVA taxes illegally do you know what recourse a tourist have? The IVA office at the airport was no help.

The law is unclear on this point. Some hotels interpret it so that you are exempt from IVA only if you have purchased a "package." I have had this interpretation asserted at the Bogota Hilton and the Alfiz in Cartagena. Both of these hotels insisted on charging IVA on the theory I had merely purchased a room, not a "package." At most other hotels, including the Hilton Cartagena, La Fe, Santa Theresa, and JW Marriott Bogota, they did not charge IVA (although I had to argue with them at the JW Marriott). You are basically at the mercy of the hotel.

I have had no problems with my hotel IVA exemptions; on the other hand I find that some hotels have tried to add on extra charges for hotel seguros (insurance) - if asked they may waive it

I have done my research, as I am reserving quite a few hotel rooms all for foreigners like myself saving almost $1,000, and the most reliable and clearly explained piece I found was from Actualicese, one of Colombia's top accounting and taxes online resources, the following (sorry its in spanish):

"Ahora, según el artículo 481 del Estatuto Tributario (modificado con el artículo 55 de la Ley) en el literal “d” sigue apareciendo que cuando un extranjero venga a Colombia, y el hotel le preste un servicio de hospedaje, se le puede cobrar sin IVA, porque eso equivale como a haber hecho una exportación del servicio y por tal motivo el artículo 481 siempre ha dejado que ese servicio de los hoteles se pueda facturar como exento."

Also, 'el seguro hotelero' is optional and should be refused at the beginning of your stay, if this is your choice.

Good luck. I know they are not supposed to charge it but they did and would not recant. That was the only hotel we had a problem with.

The law is crystal clear, but it is loosely applied by hotels.

It applies to foreigners (meaning not Colombian AND not living in Colombia)

IVA tax cannot be charged for the room.

IVA tax will apply to all other services: meals, bar, minibar, laundry, premium TV channels...

There are exceptions for San Andres, where meals are also free of IVA tax.

Unfortunately, if you did not succeed getting your hotel bill without IVA, there is no way to get your money back. DIAN cannot do anything.
