Can Casino Ask Disabled People to Get Out Of Their Scooters

I am a disabled gentleman visiting Las Vegas in May 2014. I visited the Tropicana Hotel Casino and was playing Blackjack for about an hour when the Casino Pit Boss came up to me and ask me to get out of my Mobility Scooter, because I was obstructing their staff to the Pit with my Scooter.

I was highly embarrassed, and quite annoyed, because all they had to do was to move the seat next to me.

I made a complaint to the Hotel Manager, but all I was offered was a complimentary Breakfast.

I am from Australia, and I know this would be highly illegal in Australia. People would be sacked, and major legal action would be taken.

Seems a bit of over reaction to ask people to be fired from their jobs, much less "major legal action". I can sympathize, I understand it was embarassing, and there probably is a need for staff training (or "re" training) on what constitutes reasonable accomodation. But....firing someone? Legal action? Really a bit much...

While the American Disablily Act covers a lot it does not give you the right to interrupt daily business operations and cause a safety hazard in which case you did.I agee it could have been handled more properly

they can ask...but you don't have to. if you are in an inconvenient spot they could ask you to move a bit but not to get off your scooter if you are unable to stand on your own.

Was it a "pitch" or shoe game? I know this sounds odd, but some places will require you to remain seated in THEIR chairs if it's a "pitch" game ( or double-deck) due to security reasons.

Can you sit at someplace besides 1st or 3rd base? That would seem to solve the problem at the blackjack tables.Sorry this happened to you. Enjoy your trip!

I too found a bit of inflexibility by casino staff on where I left my scooter.

I played the Lion Share slot at MGM at its present location outside the High Limit slots. I left it against the low railings going around the high limit slot area between mine and the next 'carousel' of slot machines. With my chair pushed back and the person playing in the same position on the other carousel it was difficult for staff walking behind me to get from the staff room to the high limit slots so I was asked to move it. Going around the other side of the carousel would add about 20ft to their walk!

Wow, all that for asking you to move your scooter? Sounds kind of drastic to me.

IMHO~ This is more of an issue of "poor judgement" and staff training on the part of the casino/hotel. Just a lack of common sense and stupidity on their part.

1.) The casino has to reasonably accommodate your scooter. That means you have to have access to restrooms, restaurants, elevators to rooms, etc. That does not mean that you can just park it where you want it. If any casino guest is blocking access to the pit they will be asked to move over.

2.) Like with parking a car on the street. Handicapped placard or no you cannot park in a emergency zone. You can't block someone's driveway, nor can you just say "F it" and leave it in the middle of the street. You will get towed.

3.) The person who told you to move your scooter could have been more tactful and should be spoken to and trained better, but firing him/her? Really? People need to toughen up. There are jerks in the world and mistakes happen. When the employee calls you a slur, kicks your scooter, throws a drink at you then you can talk firing.
