Restriction about being outside after 10:00 pm???

Kokopelli rental agreement has a clause stipulating we can not be outside our rental after 10:00 pm.

Had anyone heard of this? Is it strictly enforced? Definitely understand being respectful of neighbors and noise at late hours.. however this seems a bit excessive?

Red Flag! The circumstances creating the need for such a rule might be better than the incidents that would arise from enforcement. "I saw you outside after 10, so you lose your deposit." It's juvenile. We have no such restrictions on our Vacation Rentals, but they're next door.

Yes, asked Kokopelli.. was advised that due to some 'rowdy renters' the 'locals' had an ordinance passed imposing this restriction.

Was told that if complaints filed against a renter for violating, the property owner could lose their permit allowing short term rentals.

City Ordinance? What utter nonsense. No City can enforce House Arrest against citizens in this manner.

Noise? That's the problem. And thats what the ordinance addresses just as they do in every incorporated city using standard city codes does in every part of the U.S.

Our friends who own vacation rental properties in Santa Fe say it's a great idea to keep the party animals quiet, but that there is no law saying you can't have a late dinner, late movie, late Opera, late stroll, etc., or that you MUST be in your home by 10 pm.

Haven't seen the exact words of the Rental Agreement, but if it's an absolute restriction on being outside after 10 pm, then it's a noise thing that's poorly worded

The wording from the agreeement..(specific to Santa Fe properties):

Pursuant to Sante Fe City Ordinance 2009-40, no outdoor activity is allowed beyond 10:00 pm. This includes decks, portals, porches, balconies, yards or patios. You shall not violate any laws while occupying the property.....

Koko folks admit that we should have no problem enjoying a glass of wine outside after 10:00..

According to the Ordinance "Noise or other disturbance outside the short term rental unit is prohibited after 10:00 pm. This includes, but is not limited to, decks, portals, porches, balconies or patios."

That means you can be outside after 10pm, just not noisy! Sitting enjoy the evening with a glass of wine talking quietly, is not noise or disturbance. I would not worry and enjoy your trip.

Many towns have that same rule about noise after 10 pm, ours included. I can see why the property management firm would want such a clause in the rental agreement. If a property owner in a complex keeps renting to rowdies who create a problem then they should lose their right to rent their properties out to short term renters. It does no good to ticket the renters if they go home and the next week the same problem arises. There has to be some way the locals and visitors can coexist peaceably.

Ah, the devil is always in the details!!!!!!

You omit the sentence about noise and disturbance and one is left to accept the original concern about being stuck inside after 10pm.

You include it....... and it all seems very different and quite innocuous.
